It’s obvious that technology is evolving at an exponential rate. The implications for policing, today, and in the future, are significant. The proliferation of unmanned aerial systems (UAS), commonly known as drones, is an example of this. They present both opportunities and significant threats to policing and the communities the police are sworn to protect.

While drones offer incredible potential for multiple use cases, from infrastructure inspection and package delivery to agricultural monitoring and search and rescue operations, their inherent versatility also renders them susceptible to misuse by individuals and groups harboring malevolent intentions. This article delves into the increasing threat potential posed by weaponized drones within the United States, assesses the current state of preparedness and capabilities of U.S. law enforcement agencies to effectively counter such threats, and proposes a series of actionable recommendations aimed at significantly enhancing our nation's resilience against this evolving danger.

The Emerging Threat: Weaponized Drones in the Hands of Malicious Actors

The confluence of decreasing costs and increasing capabilities of commercially available drones has created an environment where these once specialized tools are now readily accessible. This “democratization” of drone technology, while fostering innovation in numerous positive domains, provides unfortunate access to individuals and groups driven by criminal or terrorist intentions. The relative ease with which commercial drones can be acquired, and the abundance of online resources detailing their modification, facilitate their weaponization. Recent global conflicts and terrorist activities abroad have illustrated the potential for even relatively unsophisticated drones to be adapted to carry explosive payloads, conduct intrusive surveillance operations, or strategically disrupt critical infrastructure and essential services.

Within the United States, a growing concern is emerging that publicizing drone tactics from distant battlefields, could encourage their replication domestically, posing a direct threat to civilian populations, key government facilities, and our national energy infrastructure. Specific examples of off-the-shelf drones that have been modified to carry explosives are now commonplace on network television programs, the Internet and social media. Coverage of the ingenuity of Ukrainian soldiers weaponizing inexpensive drones to attack Russian forces, for example, serves as a template for terrorists intent on causing death and destruction to Americans – in America. The increasing remote operational capabilities of drones amplify this threat, offering malicious actors a means to inflict harm while maintaining distance and evading immediate detection.

The Department of Homeland Security (DHS), recognizing the gravity of this evolving threat, has issued explicit warnings indicating this vulnerability, stating that U.S. cities are currently underprepared to effectively prevent and respond to potential attacks involving weaponized drones. These warnings underscore the urgent need for a comprehensive and multi-faceted approach to address this security gap before a domestic incident occurs. The potential for weaponized drones to be used in mass casualty events, targeted assassinations, or attacks on critical infrastructure necessitates a proactive and robust posture from law enforcement agencies at all levels.

Current Capabilities and Limitations of U.S. Law Enforcement

Acknowledging, and preparing for, this emerging drone threat, some U.S. law enforcement agencies have begun to explore and adopt various technologies designed to detect, identify, and monitor drone activity within their jurisdictions. These solutions typically involve a combination of sophisticated software and specialized hardware, forming multi-sensor systems capable of providing a comprehensive overview of the airspace. These systems often integrate radar, radio frequency (RF) scanners, acoustic sensors, and electro-optical/infrared (EO/IR) cameras to identify and track unauthorized drones operating within a defined area.

The data generated by these systems can provide critical real-time alerts to law enforcement personnel, enabling them to gain enhanced situational awareness regarding potential threats. Furthermore, the collected data can be invaluable for forensic analysis and the compilation of evidence in the event of a drone attack.

Despite the encouraging advances in drone detection technologies and their initial adoption by some law enforcement agencies, significant legal and operational constraints currently impede the ability of state and local law enforcement to effectively counter the full spectrum of drone threats. A complex web of federal laws and regulations primarily reserves the authority to employ certain critical counter-UAS (C-UAS) measures, such as signal jamming or drone interdiction techniques, for specific federal agencies. This existing legal framework places substantial restrictions on the actions local authorities can legally undertake, even in situations where they face a credible and imminent threat posed by a weaponized drone. Recommendations for Enhancing Law Enforcement Preparedness

To effectively address the growing domestic threat posed by weaponized drones and to ensure the safety and security of our communities, a concerted and multi-pronged effort is required. And this effort should begin now.

The following recommendations outline crucial steps that can be taken to enhance the preparedness of U.S. law enforcement agencies at all levels:

Legislative Reforms: Congress should immediately consider and enact legislation that expand the counter-UAS authority currently held by federal agencies to include well-defined and appropriately regulated permissions for state and local law enforcement agencies. This carefully considered expansion of authority would empower these frontline agencies to legally deploy a wider range of necessary technologies and tactics to effectively detect, track, and mitigate drone threats within their jurisdictions, under clear federal guidelines and oversight.

Investment in Technology: A critical component of enhancing preparedness involves a significant and sustained investment in the acquisition and deployment of advanced drone detection and mitigation systems. These investments should prioritize the selection of technologies that demonstrate proven effectiveness in real-world scenarios, ensure the safety of their deployment in diverse urban and rural environments, and strictly adhere to all relevant legal standards and privacy considerations. Strategic funding initiatives at the federal and state levels are essential to equip law enforcement agencies with the cutting-edge technologies necessary to counter this evolving threat.

Training and Policy/Protocol Development: The establishment of standardized and comprehensive training programs for state and local law enforcement personnel across the nation is crucial. In almost every case of an imminent drone attack, local cops will be the first responders. These programs should equip officers with the specialized knowledge, skills, and tactical understanding required to effectively identify, assess, and respond to various drone-related incidents, especially those involving weaponized drones. Furthermore, the development and dissemination of clear and consistent operational protocols will ensure a coordinated and effective response across different agencies and jurisdictions, minimizing confusion and maximizing the safety of both law enforcement and the public.

Public-Private Partnerships: Fostering robust and collaborative partnerships between law enforcement agencies and private sector experts and technology providers can significantly accelerate the development and deployment of innovative counter-UAS solutions. This collaboration can leverage the specialized knowledge and technological advancements within the private sector to create tailored solutions that effectively address the specific needs and challenges faced by law enforcement agencies at the state and local levels.
